FRS Pension Plan
3% Recovery to FRS: The Governor is seeking to place the 3% paid by the employee into FRS and not go toward cost savings for the employer. This will mean that the counties will not get the 3% reductions, however do not let them convince you that they do not still get a cost savings since the cuts to the pension benefits gave them a cost savings of 9 to 12%, and that savings is still there.

Fiscal Urgency:
Presently we have a bill in drafting in both the House and Senate and are waiting for the attorney’s from the unity table to agree on an approach that will do no harm. Presently, there is concern that the cases that have been won in Manatee will be effected by the bill in it’s current format. They have won their cases based upon the fact that the bill is to broad and has no definition for urgency. If we define it, it will cause these cases to be moot. I have suggested that we look for other approaches to the attorneys and they are presently working with two concepts. One concept is to simply change the word urgency to exigency which is already defined in law and has  harsher standards than emergency or concept two which is to simply add a statement that breaking employee contracts and or cutting benefits or salary of the employee will be the last action taken not the first. Our attorney Robert Klausner is working with the attorneys and will keep us apprised of the position that we should be taking, since we are currently fighting these issues in South Florida.

Law Enforcement and Correctional Officers; Providing that a law enforcement officer or correctional officer who is injured by the intentional failure of the law enforcement or correctional agency to comply with part VI, ch. 112, F.S., may petition the circuit court in the county where the law enforcement or correctional agency maintains its headquarters for an injunction to enjoin the agency from the violation and to compel the agency to perform the duties imposed by part VI, ch. 112, F.S., etc. EFFECTIVE DATE: July 1, 2012

Florida Retirement System: Revises definitions of terms "normal retirement date" & "vested" or "vesting"; revises provisions relating to early retirement benefit calculation to conform to changes made by act; requires new employees to, by default, be enrolled in investment plan; extends period during which employee may elect to participate in pension plan; prohibits certain employees from choosing to move to pension plan after certain period.
